  • The criminal recidivism issue has been an extremely relevant burden lately. The relevance of the matter is caused by the growth of its indicators.
    The article covers debatable issues of criminal and legal classification of recidivism. It is composed of three parts each dealing with the description of three basic aspects: revealing problematics of criminal punishment in cases of recidivism, extensive coverage of different scientific approaches aimed at solving problems revealed as well as presenting the authors' proposals of how relevant criminal legislation should be further developed.
    On the basis of the present research results the authors have made a conclusion emphasizing the need for strict differentiation in terms of awarding punishment in case of different types of recidivism, as well as necessity of further developing recidivism classification types. In addition the authors have proposed their own legal definitions and have worked out the lower limit for punishment dealing with different types of recidivism. The authors' proposals with regard to the development of criminal legislation are innovative ones and they make it possible to keep on developing as well as further researching the institution of recidivism.
