  • The article studies theoretical and practical matters dealing with compensation for property damages under rehabilitation in the course of criminal proceedings. In the authors’ opinion the property harm caused to a citizen by law enforcement authorities is a material damage and losses resulted from the enforcement under criminal law which is used by inquiry officers, investigation and public prosecution agencies along with legal agencies with regard to suspects or defendants.
    The article explores the basic stages of the formation and the development of the institution of rehabilitation in the Russian criminal procedure, it analyzes examples drawn from the practice of compensation of property damages in the course of rehabilitation, it reveals problematic issues of implementation of criminal procedure legislation and defines perspectives for further development of the bodies of investigation and preliminary investigation and court in the above mentioned sphere.
