  • The article is devoted to the comprehensive study of forensic expertise considered to be one of the types of proceedings performed in the framework of criminal, civil, arbitration and administrative litigation. In addition, the forensic examination is examined as an independent legal institution.
    The article focuses on such hallmarks of forensic expertise as the need for the study of physical objects presented to an expert, the concept of special knowledge the necessity of implementation whereof is the basis to order expertise, the legal grounds for obtaining expert opinions, the differences between forensic expertise and other related forms of implementing special knowledge’s of officials with expert competence.
    On the basis of the research conducted the authors propose optimizing the concept of forensic expertise to be fixed in the Federal Law "On State Forensic Activity in the Russian Federation".
