Public Danger of Crimes Regarding Illicit Trafficking in Pharmaceutical Products

The article discusses main criteria defining the nature and degree of public danger of crimes in the field of illicit trafficking in pharmaceutical products. The study focuses on trends in the development of the domestic pharmaceutical market. The research is based on the risk-oriented analysis conducted with regard to consequences of the implementation of a legislative initiative aimed at granting pharmaceutical market entities the right to manufacture medicines registered in the Russian Federation. The paper provides categorization of crimes under Articles 2351, 2381 and 3272 of the Criminal Code of the Russian Federation, which collectively form the illegal turnover of pharmaceutical products. The authors conclude that the greatest public danger is posed by the act provided for in Article 2381 of the Criminal Code of the Russian Federation, and present main qualifying signs that increase the degree and nature of the public danger of the crimes under consideration.
