  • The article covers criminal proceedings issues which have always been fraught with definite restrictions of rights and freedoms of citizens both facing criminal prosecution or other participants in criminal proceedings. Illegal or groundless conducting investigative actions has negative aftereffects dealing with the need for the follow up rehabilitation of citizens, who have illegally been criminally prosecuted.
    Making decision in favour of conducting investigative actions on the basis of clear understanding and correct assessing factual and legal grounds minimizes the possibility of conducting illegal actions by authorized bodies and provides a better defending of the rights and freedoms of citizens respectively.
